Terms and conditions.

  1. Client represents and warrants to Leo’s Clubhouse that as of each date on which he or she leaves a pet with Leo’s Clubhouse, and with respect to each pet (if more than one):

    • Client is the rightful owner or caretaker of the pet

    • Pet is not less than sixteen (16) weeks old.

    • The pet is current on all required vaccinations and such other vaccinations as may be required by Leo’s Clubhouse (Client agrees to provide documents confirming such vaccinations if requested by Leo’s Clubhouse).

    • The pet, if male, is neutered, or will be neutered prior to boarding with Leo’s Clubhouse.

    • Unless otherwise disclosed to Leo’s Clubhouse, the pet is housebroken and to Client's knowledge, the pet is not prone to chewing, scratching, digging or other destructive behavior.

    • To Client's knowledge, the pet is free of fleas, ticks, worms and other insects and parasites.

    • To Client's knowledge, the pet is in good health and has no current illness or injury, except as has been disclosed to Leo’s Clubhouse.

    • To Client's knowledge, the pet has not bitten, or exhibited other aggressive behavior, towards any person or animal, except as has been previously disclosed to Leo’s Clubhouse.

  2. Client covenants and agrees with respect to each pet to:

    • Provide Leo’s Clubhouse with a sufficient amount of pet food to feed the pet according to his or her normal feeding schedule while in Leo’s Clubhouse’s care.

    • Provide clearly marked medicine with instructions to Leo’s Clubhouse, if applicable, and Client hereby authorizes Leo’s Clubhouse to administer such medicine to the pet in accordance with such instructions.

    • Pay for any veterinary and related services needed while the pet is in Leo’s Clubhouse’s care either through (i) pre-arrangement with the pet's regular veterinarian or (ii) providing a credit card number and billing authorization to Leo’s Clubhouse prior to any services being provided under these Terms and Conditions. Client agrees to pay for any veterinary related services directly to the facility providing care.

  3. Subject to Paragraph 4 below, Client hereby authorizes Leo’s Clubhouse to seek veterinary care in the event a pet is injured or becomes ill while in Leo’s Clubhouse’s care. They will use their reasonable judgment in such situations and authorize and instruct Client's primary veterinarian to share the pet's medical records with Leo’s Clubhouse and any emergency or other veterinary clinic as necessary to provide the best veterinary care for the pet under the circumstances. Leo’s Clubhouse’s preferred veterinary services include VCA University Animal Hospital, VCA Family Pearl City, or VERC.

  4. Client has provided Leo’s Clubhouse with a name and phone number for an emergency contact person. In the event a pet is injured or becomes ill while in Leo’s Clubhouse’s care, if Client cannot be contacted, such emergency contact person is authorized to make all decisions regarding the extent of any medical treatment for the pet. In the event that neither Client nor the emergency contact can be contacted, Leo’s Clubhouse is hereby authorized to allow charges on emergency veterinary expenses as reasonably determined by Leo’s Clubhouse and Client agrees to pay for any such emergency veterinary expenses.

  5. Unless special arrangements are made in advance, Client agrees to check in pet between 1:00 pm and 5:00 pm HST on the confirmed check in date and check out pet between 9:00 am and 12:00 pm HST on the confirmed check out date. Unless otherwise waived by Leo’s Clubhouse in its sole discretion, Client and Leo’s Clubhouse must confirm check in and check out appointments in advance. If the pet is not picked up by 12:00 pm HST on the confirmed check out date, unless otherwise arranged and agreed upon by the Client and Leo’s Clubhouse, then the Client may be charged for additional time of boarding and Leo’s Clubhouse reserves the right to hold the pet in a temporary container until picked up by the Client. Client agrees to pay all additional fees incurred as a result of the pet’s extended stay.

  6. If there has been any recent recovery by the pet from illness or injury within the last thirty (30) days, Client must provide a veterinarian’s note confirming the pet’s fitness for boarding. Leo’s Clubhouse reserves the right to decline a pet for boarding for any reason, in its sole discretion, including but not limited to: (i) lack of valid documentation verifying the pet’s eligibility; (ii) a pet not meeting the boarding criteria under these Terms and Conditions or other rules and policies adopted by Leo’s Clubhouse; (iii) a pet exhibiting illness or injury at check-in; or (iv) a pet exhibiting excessive aggression during check in.

  7. Leo’s Clubhouse may require topical flea treatment prior to arrival, and proof of any such topical flea treatment may be required from Client, in Leo Clubhouse’s sole discretion. Client authorizes Leo’s Clubhouse to take any reasonable measures to treat fleas that are found on or after check in and while boarding with Leo’s Clubhouse.

  8. Client acknowledges and agrees that the pet must have completed the full course of FVRCP vaccination shots prior to boarding with Leo’s Clubhouse that is sufficient to cover the boarding time with Leo’s Clubhouse. Any exemption or deviation from vaccination requirements requires a veterinarian’s note explaining the reason, certifying suitability for boarding, and such note must be approved by Leo’s Clubhouse, in its sole discretion.

  9. Pets generally do not interact with one another while under the care and boarding at Leo’s Clubhouse. However, and unless Client has otherwise instructed Leo’s Clubhouse to the contrary, Client acknowledges and agrees that his or her pet may encounter and be allowed to interact and play with other cats and other pets and with people. Client further acknowledges that cats can be unpredictable and that there is a possibility of injury to the pet or to another animal or a person.

  10. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIENT (A) HEREBY RELEASES LEO’S CLUBHOUSE, ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR ANY INJURY OR ILLNESS SUFFERED BY HIS OR HER PET WHILE IN LEO’S CLUBHOUSE’S CARE, EXCEPT TO THE EXTENT SUCH ILLNESS OR INJURY IS THE RESULT OF LEO’S CLUBHOUSE’S GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT; AND (B) AGREES NOT TO INITIATE ANY LEGAL PROCEEDINGS AGAINST LEO’S CLUBHOUSE WITH RESPECT TO SUCH RELEASED CLAIMS.

  11. WITHOUT LIMITING PARAGRAPH 10 ABOVE, LEO’S CLUBHOUSE’S AGGREGATE LIABILITY FOR FAILURE TO PERFORM UNDER THESE TERMS AND CONDITIONS OR ANY INJURY OR ILLNESS TO A PET WILL BE LIMITED TO THE LESSER OF (A) THE COST OF THE STAY DURING WHICH THE FAILURE, INJURY OR ILLNESS OCCURRED OR (B) $500. IN NO EVENT WILL LEO’S CLUBHOUSE BE LIABLE FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THEIR POSSIBLE EXISTENCE.

  12. CLIENT WILL INDEMNIFY, DEFEND AND HOLD LEO’S CLUBHOUSE HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, DAMAGES, FINES, PENALTIES AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM OR RESULTING FROM ANY BREACH OF THE REPRESENTATIONS, WARRANTIES OR COVENANTS CONTAINED IN THESE TERMS AND CONDITIONS.

  13. Leo’s Clubhouse may refuse to provide pet care services or arrange for any pet care services for any reason, in Leo’s Clubhouse’s sole and absolute discretion.

  14. A 30% deposit fee will be collected at time of booking and the rest of payment collected at check out. Client agrees that any overages for a pickup day and time in excess of that reserved and prepaid, may be charged to the credit card on file or otherwise will be paid immediately upon return.

  15. FULL REFUNDS less a $25 cancellation fee will be given for booked reservations that cancel at least 14 days prior to the pet drop off date. NO REFUNDS or partial refunds will be given for cancellations with less than 7 days notice prior to the pet drop off date or for early pet pick up. For reservations that are made and begin less than 7 days before the pet drop off date — the sale is final at the time we receive payment.

  16. If Client does not pick up the pet on the date it is due to be picked up, or another time arranged and agreed upon by Client and Leo’s Clubhouse, then Leo’s Clubhouse will exercise all of its rights under Hawaii law with regard to the abandonment of the pet and Client agrees to pay for all costs related thereto, including attorney fees and court costs.

  17. These Terms and Conditions will govern any reservation form, pet information sheet, instructions from Client or other document relating to services to be provided by Leo’s Clubhouse.

  18. These Terms and Conditions are governed by the laws of the State of Hawaii, without regard to conflicts of law principles.

  19. If any provision of these Terms and Conditions is determined to be unenforceable, such provision will be deemed severed and the remaining provisions of these Terms and Conditions will continue in full force and effect.

  20. Leo’s Clubhouse will be deemed to have accepted these Terms and Conditions, without execution, upon the earlier of Leo’s Clubhouse acceptance of a reservation or payment for services to be provided hereunder or the commencement of the actual provision of services hereunder, subject to Leo’s Clubhouse right to refuse services to any person or animal.
